Amazon Pharmacy Terms of Use

Welcome to Amazon Pharmacy. PillPack LLC dba PillPack by Amazon Pharmacy and/or its affiliates ("Amazon Pharmacy") provide website features and other products and services to you when you visit amazon.com/pharmacy or pharmacy.amazon.com, use Amazon Pharmacy products or services, or interact or communicate with Amazon Pharmacy (collectively, "Amazon Pharmacy Services").

These Amazon Pharmacy Terms of Use supplement the terms and conditions set forth in the Amazon.com Conditions of Use and Amazon.com Privacy Notice. Before using Amazon Pharmacy Services please read the Amazon.com Conditions of Use, Amazon.com Privacy Notice, these Amazon Pharmacy Terms of Use, Amazon Pharmacy help content, and all other applicable rules, policies, and terms posted on the Amazon Pharmacy website, Amazon.com/pharmacy (collectively, the "Agreement"). By using Amazon Pharmacy Services, you are agreeing to be bound by the terms of the Agreement. If you do not agree to the terms of the Agreement, you may not use Amazon Pharmacy Services.

PHARMACY SERVICES

Amazon Pharmacy provides pharmacy services through its licensed pharmacies and pharmacists.

PRIVACY OF YOUR HEALTH INFORMATION

Amazon Pharmacy is subject to HIPAA, which governs how we may use and disclose your Protected Health Information, such as medication history, medical conditions, health insurance information, and other personal information we use to provide prescriptions. Our Notice of Privacy Practices, and not Amazon's Privacy Notice, describes that use and disclosure. Please see our Notice of Privacy Practices for more information on HIPAA, Protected Health Information, and how you may access your Protected Health Information.

AMAZON PHARMACY PROFILE

You will need an Amazon Pharmacy profile to use Amazon Pharmacy Services. If you are under 18, you may access Amazon Pharmacy services only by utilizing PillPack by Amazon Pharmacy with the involvement of a parent or guardian. You agree to provide and maintain true, current, and complete information about yourself and any dependents. You may establish and use a personal identification number to create and access your Amazon Pharmacy profile. If you do not set a personal identification number, other people with whom you share your Amazon account might be able to access your Amazon Pharmacy profile.

HEALTH-RELATED CONTENT

Please carefully review product information and package inserts regarding dosage, warnings, interactions, and other information before administering or using any device, drug, herb, vitamin, or supplement received through any Amazon Pharmacy Service. For other health-related content provided we try to be as accurate as possible, however such content is for reference only and describes general principles of health care and are not specific instructions for individual patients. PAYMENT OBLIGATIONS

You are responsible for the copays set by your insurance plan and cash purchases. If there is a problem charging your selected payment method for a copay or cash purchase we may charge any other valid payment method associated with your account.

COMMUNICATIONS WITH AMAZON PHARMACY

You consent to receive communications (including emails, texts, mobile push notifications, or notices and messages on this Web site or through other Amazon Pharmacy Services) by or on behalf of Amazon to any email address, phone number, or mobile device associated with your account or otherwise directly or indirectly provided to Amazon. Communications we send to you may include information about your prescriptions, treatment, or benefits, and, in connection with such communications, we may use pre-recorded/artificial voice messages and/or automatic dialing devices. If you choose to share access to your mobile phone, carrier account, email, or Amazon Pharmacy profile with others, those individuals might also be able to see this information. Our Notice of Privacy Practices provides more information on how you may receive communications from us.

ACCESS TO AND USE OF AMAZON PHARMACY SERVICES

Except as provided in our Notice of Privacy Practices, Amazon may terminate or suspend your access to and use of the Amazon Pharmacy Services and/or your Amazon Pharmacy profile without notice, for any reason, at any time.

MULTIPLE FACILITIES

Your prescription may be processed and medication order filled at any licensed pharmacy in our network in compliance with pharmacy regulations, including third-party licensed pharmacies. The dispensing pharmacy will always be identified on the prescription label.

MODIFICATIONS

We may change, suspend, or discontinue the Amazon Pharmacy Services, or any part of it, at any time without notice. We may amend any of this Agreement's terms at our sole discretion by posting the revised terms on the Amazon.com website. Your continued use of the Amazon Pharmacy Services after the effective date of the revised Agreement constitutes your acceptance of the terms. Amazon's failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.

DISPUTES

Any dispute or claim relating in any way to your use of any Amazon Pharmacy Service or this Agreement will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of this Agreement as a court would.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent Corporation Service Company, 300 Deschutes Way SW, Suite 304, Tumwater, WA 98501. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. We will reimburse those fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous. Likewise, Amazon will not seek attorneys' fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Without limiting the Disclaimer of Warranties and Limitation of Liability terms in the Amazon.com Conditions of Use, and unless otherwise required by applicable law, in no event will our aggregate liability with respect to any claim arising from or relating to this Agreement or your use of the Amazon Pharmacy Services exceed the fees paid by you for the particular information or service provided.
