Please spread the word, we've updated NoEarnItAct.org to make it super easy to email and then call your lawmakers and Senate leadership telling them to oppose the EARN IT Act. If enough people do this, we can get them to shelve this terrible bill like they did last time

The Senate Judiciary passed the #EARNITAct this morning. During the markup, @SenMikeLee did a great job of breaking down why the bill could open up small Internet companies and websites to costly litigation under state laws.

FYI - If this tool doesn't work, you can call 202-224-3121 and ask to speak to your Senators (remember you have two). Make sure the person in the office gets your name and address, and you are clear on what you want. Doesn't have to be a thing. "Oppose EARN IT" is enough.

Anyway. I love it when it’s clear that private companies make BUSINESS decisions on what speech to host (never forget: they are not the gov’t, they are not the town square, they are here to make $$$), and consumers get to decide where to take their business.

Wouldn’t it be great if the same were true of more giant tech companies? Don’t like FB’s business decisions to ham handedly filter hate speech? Take your business to Friendster, or whatever.

In this case, there is somewhere else for consumers to go. There are many choices for streaming music platforms. If it were easy to move your playlists with your business (adversarial interoperability) that would be even better, but it’s still pretty easy.

To be clear - I don’t think that “free markets” actually exist. But here, a company made a business decision (keep Joe R*gan), and unhappy consumers responded by taking their business elsewhere.

I waited tables part-time almost the entire time I worked on the Hill to be able to afford to work on the Hill. I was lucky that I found a bar willing to work around my schedule, and that I was healthy enough to be able to do both.

California does, which has been a huge relief. It means I can stress about why my baby has suddenly decided not to take a bottle, and not my budget. That has a clear and obvious positive impact, both for my little family and broader economy.
