    Top ebooks in law

    Named one of the most important nonfiction books of the 21st century by Entertainment Weekly‚ Slate‚ Chronicle of Higher Education‚ Literary Hub, Book Riot‚ and Zora

    A tenth-anniversary edition of the iconic bestseller—"one of the most influential books of the past 20 years," according to the Chronicle of Higher Education—with a new preface by the author

    "It is in no small part thanks to Alexander's account that civil rights organizations such as Black Lives Matter have focused so much of their energy on the criminal justice system."
    —Adam Shatz, London Review of Books

    Seldom does a book have the impact of Michelle Alexander's The New Jim Crow. Since it was first published in 2010, it has been cited in judicial decisions and has been adopted in campus-wide and community-wide reads; it helped inspire the creation of the Marshall Project and the new $100 million Art for Justice Fund; it has been the winner of numerous prizes, including the prestigious NAACP Image Award; and it has spent nearly 250 weeks on the New York Times bestseller list.

    Most important of all, it has spawned a whole generation of criminal justice reform activists and organizations motivated by Michelle Alexander's unforgettable argument that "we have not ended racial caste in America; we have merely redesigned it." As the Birmingham News proclaimed, it is "undoubtedly the most important book published in this century about the U.S."

    Now, ten years after it was first published, The New Press is proud to issue a tenth-anniversary edition with a new preface by Michelle Alexander that discusses the impact the book has had and the state of the criminal justice reform movement today.

    #1 NEW YORK TIMES BESTSELLER • NOW A MAJOR MOTION PICTURE STARRING MICHAEL B. JORDAN AND JAMIE FOXX • A powerful true story about the potential for mercy to redeem us, and a clarion call to fix our broken system of justice—from one of the most brilliant and influential lawyers of our time.

    “[Bryan Stevenson’s] dedication to fighting for justice and equality has inspired me and many others and made a lasting impact on our country.”—John Legend

    NAMED ONE OF THE MOST INFLUENTIAL BOOKS OF THE DECADE BY CNN • Named One of the Best Books of the Year by The New York Times • The Washington Post • The Boston Globe • The Seattle Times • Esquire • Time

    Bryan Stevenson was a young lawyer when he founded the Equal Justice Initiative, a legal practice dedicated to defending those most desperate and in need: the poor, the wrongly condemned, and women and children trapped in the farthest reaches of our criminal justice system. One of his first cases was that of Walter McMillian, a young man who was sentenced to die for a notorious murder he insisted he didn’t commit. The case drew Bryan into a tangle of conspiracy, political machination, and legal brinksmanship—and transformed his understanding of mercy and justice forever.

    Just Mercy is at once an unforgettable account of an idealistic, gifted young lawyer’s coming of age, a moving window into the lives of those he has defended, and an inspiring argument for compassion in the pursuit of true justice.

    Winner of the Carnegie Medal for Excellence in Nonfiction • Winner of the NAACP Image Award for Nonfiction • Winner of a Books for a Better Life Award • Finalist for the Los Angeles Times Book Prize • Finalist for the Kirkus Reviews Prize • An American Library Association Notable Book

    “Every bit as moving as To Kill a Mockingbird, and in some ways more so . . . a searing indictment of American criminal justice and a stirring testament to the salvation that fighting for the vulnerable sometimes yields.”—David Cole, The New York Review of Books

    “Searing, moving . . . Bryan Stevenson may, indeed, be America’s Mandela.”—Nicholas Kristof, The New York Times

    “You don’t have to read too long to start cheering for this man. . . . The message of this book . . . is that evil can be overcome, a difference can be made. Just Mercy will make you upset and it will make you hopeful.”—Ted Conover, The New York Times Book Review

    “Inspiring . . . a work of style, substance and clarity . . . Stevenson is not only a great lawyer, he’s also a gifted writer and storyteller.”The Washington Post

    “As deeply moving, poignant and powerful a book as has been, and maybe ever can be, written about the death penalty.”—The Financial Times

    “Brilliant.”—The Philadelphia Inquirer
    A powerful true story about a shocking crime and a mysterious illness that will forever change your notions of how we punish and how we heal—an expansion on one of the most popular This American Life episodes of all time

    “A remarkable medical detective story–cum–memoir, grippingly told . . . I was drawn in by every part of it.”—Atul Gawande, #1 New York Times bestselling author of Being Mortal

    Fresh out of medical residency, Dr. Benjamin Gilmer joined a rural North Carolina clinic only to find that its previous doctor shared his last name. Dr. Vince Gilmer was loved and respected by the community—right up until he strangled his ailing father and then returned to the clinic for a regular week of work. Vince’s eventual arrest for murder shocked his patients. How could their beloved doctor be capable of such violence? The deeper Benjamin looked into Vince’s case, the more he became obsessed with discovering what pushed a good man toward darkness.

    When Benjamin visited Vince in prison, he met a man who appeared to be fighting his own mind, constantly twitching and veering into nonsensical tangents. Sentenced to life in prison, Vince had been branded a cold-blooded killer and a “malingerer”—a person who fakes an illness. But it was obvious to Benjamin that Vince needed help. Alongside This American Life journalist Sarah Koenig, Benjamin resolved to understand what had happened to his predecessor. Time and again, the pair came up against a prison system that cared little about the mental health of its inmates—despite more than a third of them suffering from mental illness.

    The Other Dr. Gilmer
    takes readers on a riveting and heart-wrenching journey through our shared human fallibility, made worse by a prison system that is failing our most vulnerable citizens. With deep compassion and an even deeper sense of justice, Dr. Benjamin Gilmer delves into the mystery of what could make a caring doctor commit a brutal murder. And in the process, his powerful story asks us to answer a profound question: In a country with the highest incarceration rates in the world, what would it look like if we prioritized healing rather than punishment?
    The legendary FBI criminal profiler, number-one New York Times bestselling author, and inspiration for the hit Netflix show Mindhunter delves deep into the lives and crimes of four of the most disturbing and complex predatory killers, offering never-before-revealed details about his profiling process, and divulging the strategies used to crack some of America’s most challenging cases.

    The FBI’s pioneer of criminal profiling, former special agent John Douglas, has studied and interviewed many of America’s most notorious killers—including  Charles Manson, ”Son of Sam Killer” David Berkowitz and ”BTK Strangler” Dennis Rader—trained FBI agents and investigators around and the world, and helped educate the country about these deadly predators and how they operate, and has become a legend in popular culture, fictionalized in The Silence of the Lambs and the hit television shows Criminal Minds and Mindhunter.

    Twenty years after his famous memoir, the man who literally wrote the book on FBI criminal profiling opens his case files once again. In this riveting work of true crime, he spotlights four of the most diabolical criminals he’s confronted, interviewed and learned from. Going deep into each man’s life and crimes, he outlines the factors that led them to murder and how he used his interrogation skills to expose their means, motives, and true evil. Like the hit Netflix show, The Killer Across the Table is centered around Douglas’ unique interrogation and profiling process. With his longtime collaborator Mark Olshaker, Douglas recounts the chilling encounters with these four killers as he experienced them—revealing for the first time his profile methods in detail.

    Going step by step through his interviews, Douglas explains how he connects each killer’s crimes to the specific conversation, and contrasts these encounters with those of other deadly criminals to show what he learns from each one. In the process, he returns to other famous cases, killers and interviews that have shaped his career, describing how the knowledge he gained from those exchanges helped prepare him for these.

    A glimpse into the mind of a man who has pierced the heart of human darkness, The Killer Across the Table unlocks the ultimate mystery of depravity and the techniques and approaches that have countered evil in the name of justice.

    Klaus Vogel on Double Taxation Conventions is regarded as the international gold standard on the law of tax treaties. This article-by-article commentary has been completely revised and updated to give you a full and current account of double tax conventions (DTCs).

    DTCs form the backbone of international taxation, but they raise many interpretational questions. This market leading work will provide you with the answers.

    Based on the OECD/G20 Multilateral Instrument, the OECD MC and Commentary published in 2017 and the most recent amendments to the UN MC, the book also includes relevant case law and scholarly literature upto and including 2020.

    Previous editions of the Vogel have been routinely relied on by courts around the world including Australia, Canada, Germany, India, South Africa, the Netherlands and United Kingdom.

    What’s new in this edition?

    There have been many important developments in this area since the last edition in 2015. The authors discuss these developments and the effect they will have upon practitioners working in this area. They also provide a wealth of new and revised case law, along with the DTCs of emerging countries.

    You’ll find:

    • Reports about major features in the DTC practice of many leading jurisdictions, such as:

    1. the DTC practice of Austria, Canada, France, Germany, India, the Netherlands, Switzerland, the UK and the US

    2. Sections on divergent country practice covering their national models and networks of bilateral DTCs

    • Thorough analysis of the OECD and UN model, as well as the implementation of these models in practice

    • Amendments of bilateral DTCs, textual or in substance, on the basis of the 2017 Anti-BEPS Multilateral Instrument

    • Coverage of a full range of the latest tax treaties around the world, including important treaties between OECD and BRICS countries

    This new Fifth Edition of Klaus Vogel on Double Taxation Conventions continues to reflect the unchallenged role of the OECD. The OECD MC, accompanied by the official Commentary, guidelines, reports and other recommendations, has sustained its position as the most important legal instrument in the area of DTCs.

    On occasion, the UN MC and Commentary diverge from the OECD texts. When this happens, the authors deal with the specifics of the UN MC in separate annotations and analyses, explaining and making sure you understand the differences.

    On December 24, 1968, ten-year-old Pamela Powers was brutally murdered, her body dumped at the side of the road to freeze. Robert Anthony Williams was charged with the crime, and a series of trials, appeals, and reversals ensued. The Christian Burial Case: An Introduction to Criminal and Judicial Procedure introduces readers to the intricacies of the American legal system, using the Williams case to illustrate all the stages of the legal process from the point of arrest, to the trial, the appellate process, and, ultimately, the Supreme Court. The text clearly and concisely explains criminal and court procedures in the context of the Williams case, paying careful attention to the rights against self-incrimination and to counsel, and to the role of the exclusionary rule in our system of justice. This unique introduction to criminal justice and judicial procedure captures the imagination of the reader as it chronicles The Christian Burial case from beginning to end.

    Because the suspect was observed leaving the scene of the crime with the body of the victim, the Williams case seemed to be open and shut. But due to police procedures in apprehending and questioning the suspect, the resolution of the case took fifteen years and two United States Supreme Court decisions. By highlighting the difficulties of determining the facts of the case and the proper procedural laws that were applicable, McInnis demonstrates the complexities inherent in the legal system. This compelling book is a must-read for all people interested in learning more about criminal procedure and judicial processes.

    E-commerce and EU VAT: Theory and Practice
    Rosamund Barr, Jeroen Bijl, Nils Bleckman, Gijsbert Bulk, Ethan Ding & Matthias Luther

    The new EU rules governing online sales of goods and services affect all businesses that sell online to EU customers, no matter where the seller is based. This timely book, written by leading tax professionals from various EU countries, is the first to clearly explain the VAT compliance obligations and options that businesses and tax practitioners worldwide must understand in order to adapt to the new system. In addition to describing the legal framework, the authors provide examples of how the rules work in practice and illustrate available choices for businesses, with particular attention to avoiding pitfalls.

    Thoroughly describing the rules affecting place of supply, liability, and accounting procedures in all relevant contexts, the book covers such areas of VAT compliance as the following:

    • distinction between goods and services;
    • differences between imported goods and goods sold intra-EU;
    • filing and invoicing obligations under the new one-stop shop scheme;
    • reclaiming foreign VAT;
    • mitigating fears of fraud and hijacking;
    • distinction between business-to-customer and business-to-business transactions; and
    • navigating through appeals, mistakes, and adjustments.

    Also covered are the particular VAT variations applicable to transactions involving the major European non-EU states – Norway, Switzerland, and the United Kingdom. The important distinction between the concept of ‘nexus’ in the United States state and local tax rules and ‘place of supply’ under EU law is also fully explored.

    Because a very large number of remote sellers of goods and services will need to understand and comply with the changes in the EU VAT e-commerce rules, it goes without saying that this book is indispensable to in-house corporate counsel worldwide. Tax administration officials, professionals in indirect tax management, corporate tax and finance directors and other tax professionals, and academics concerned with indirect tax law are sure to welcome this essential resource.

    Innovating Construction Law: Towards the Digital Age takes a speculative look at current and emerging technologies and examines how legal practice in the construction industry can best engage with the landscape they represent. The book builds the case for a legal approach based on transparency, traceability and collaboration in order to seize the opportunities presented by technologies such as smart contracts, blockchain, artificial intelligence, big data and building information modelling. The benefits these initiatives bring to the construction sector have the potential to provide economic, societal and environmental benefits as well as reducing the incidence of disputes.

    The author uses a mixture of black letter law and socio-legal commentary to facilitate the discourse around procurement, law and technology. The sections of the book cover the AS IS position, the TO BE future position as predicted and the STEPS INBETWEEN, which can enable a real change in the industry. The rationale for this approach lies in ensuring that the developments are congruent with the existing frameworks provided by the law. The book proposes various steps that the industry should seriously consider taking from the current position to shape the future of the sector and ultimately create a better, more productive and sustainable construction industry.

    This book is a readable and engaging guide for students and practitioners looking to learn more about construction law and its relationship with technology and for those seeking a platform for graduate studies in this area.

    In recent years, there has been a sharp rise in acts of violence in the courts. These acts range from minor disturbances and physical assaults to murder and mass destruction. The potential exists for violence to occur in any court system regardless of location. Unfortunately, many courts at all levels of the judicial system have been slow or even reluctant to implement adequate security measures. This book is designed to prove the folly in such denial. It provides hard statistics and observations that highlight this unique visceral security environment. The text is specifically designed to help those charged with developing and implementing security measures to reevaluate current methods for safeguarding the judicial process. Presented in four sections, the first discusses perpetrators planning an attack and reviews types of perpetrators, target selection, tactics, operations styles, the mechanics of violent attacks, and thwarting attacks. Section two discusses in much detail a multitude of integrated security systems now available for court facilities. The third section presents effective response mechanics for courthouse violence, and the final section reviews tactical considerations for training, containment, and responding to explosive devices. The text serves as a substantial resource in providing the most current state-of-the-art information on security operations and technologies in a very clear but in-depth format. The ultimate goal of this book is to emphasize that court security in today's world must be constantly reexamined, revamped, and upgraded to protect human and physical assets. This unique and comprehensive text will be invaluable to courthouse adminstrators, security professionals, law enforcement personnel, judges, lawyers, and college-level students of security.
    William D. Lopez details the incredible strain that immigration raids place on Latino communities—and the families and friends who must recover from their aftermath.

    2020 International Latino Book Awards Winner First Place, Mariposa Award for Best First Book - Nonfiction Honorable Mention, Best Political / Current Affairs Book

    On a Thursday in November 2013, Guadalupe Morales waited anxiously with her sister-in-law and their four small children. Every Latino man who drove away from their shared apartment above a small auto repair shop that day had failed to return—arrested, one by one, by ICE agents and local police. As the two women discussed what to do next, a SWAT team clad in body armor and carrying assault rifles stormed the room. As Guadalupe remembers it, "The soldiers came in the house. They knocked down doors. They threw gas. They had guns. We were two women with small children . . . The kids terrified, the kids screaming."

    In Separated, William D. Lopez examines the lasting damage done by this daylong act of collaborative immigration enforcement in Washtenaw County, Michigan. Exploring the chaos of enforcement through the lens of community health, Lopez discusses deportation's rippling negative effects on families, communities, and individuals. Focusing on those left behind, Lopez reveals their efforts to cope with trauma, avoid homelessness, handle worsening health, and keep their families together as they attempt to deal with a deportation machine that is militarized, traumatic, implicitly racist, and profoundly violent.

    Lopez uses this single home raid to show what immigration law enforcement looks like from the perspective of the people who actually experience it. Drawing on in-depth interviews with twenty-four individuals whose lives were changed that day in 2013, as well as field notes, records obtained under the Freedom of Information Act, and his own experience as an activist, Lopez combines rigorous research with moving storytelling. Putting faces and names to the numbers behind deportation statistics, Separated urges readers to move beyond sound bites and consider the human experience of mixed-status communities in the small towns that dot the interior of the United States.

    Special Education Law, Sixth Edition, written by Laura Rothstein and Scott F. Johnson, provides a comprehensive and current overview of the major federal law, and judicial interpretations of those laws, that apply to special education students. School administrators and attorneys attend to special education issues on a regular basis, and local superintendents, principals, special education professionals, psychologists, and regional and state administrators must also be familiar with the legal requirements of educating students with disabilities. Classroom teachers in all types of classrooms need to be aware of the laws that affect them and their students. Special Education Law 6e is intended for students in education and educational administration, both graduate and undergraduate, as well as law students in courses on special education law, school law, and special education.

    The framework of this book begins with five introductory chapters on the major issues that are addressed in special education
    law. These topics include an overview the legal system, the history of special education, major statutes in special education law, stakeholders such as students, families, educators, and advocates, and finally, requirements for protection under various special education laws. The remainder of the text presents and analyzes special education case law within specific contexts. The text helps educators understand what the law requires so that they can make decisions that comply with these laws.

    Updates for the sixth edition include a major reorganization of the text. Chapters have been streamlined and edited for clarity, combining a previous chapter on Related Services with Free Appropriate Publication Education, and folding Eligibility into Identification, Evaluation, and Eligibility, so students can better see the connections between these topics. Many case excerpts have been shortened or summarized to provide students with a more straightforward and focused reading experience. The latest updates in statutes, regulations, and case law are included throughout the text.
    Featuring 15 explosive new chapters, this new edition of the New York Times bestseller brings the story of Economic Hit Men up-to-date and, chillingly, home to the U.S.―but it also gives us hope and the tools to fight back.

    Former economic hit man John Perkins shares new details about the ways he and others cheated countries around the globe out of trillions of dollars. Then he reveals how the deadly EHM cancer he helped create has spread far more widely and deeply than ever in the US and everywhere else—to become the dominant system of business, government, and society today. Finally, he gives an insider view of what we each can do to change it.

    Economic hit men are the shock troops of what Perkins calls the corporatocracy, a vast network of corporations, banks, colluding governments, and the rich and powerful people tied to them. If the EHMs can't maintain the corrupt status quo through nonviolent coercion, the jackal assassins swoop in. The heart of this book is a completely new section, over 100 pages long, that exposes the fact that all the EHM and jackal tools—false economics, false promises, threats, bribes, extortion, debt, deception, coups, assassinations, unbridled military power—are used around the world today exponentially more than during the era Perkins exposed over a decade ago.

    As dark as the story gets, this reformed EHM also provides hope. Perkins offers specific actions each of us can take to transform what he calls a failing Death Economy into a Life Economy that provides sustainable abundance for all.

    We know the real estate licensing exam can be tough, and very nerve-wracking to prepare for. That’s why we created the Texas Real Estate License Exam Prep (TX-RELEP) the way we did. Since we have been managing real estate schools and developing curriculum for forty years, we know how all this works – or fails to work.

    TX-RELEP is comprehensive in that it contains both key content review and testing practice. And the text review is Texas-specific – not just simplistic national content, but terse, relevant and accurate Texas laws and regulations presented as a well-organized set of state ‘key point reviews’ ideal for pre-test memorization. But let’s not dismiss the importance of the national content either. TX-RELEP’s national key point reviews are a succinct compression of tested national principles and practices that comprise the national portion of state license exams from coast to coast. Our content is drawn from our own national textbook, Principles of Real Estate Practice – one of the most widely used principles textbooks in the country. Finally, our national content, as well as our question selection, is further tailored to the state testing outline promulgated by Pearson Vue for Texas. Thus the breadth and depth of the law reviews and test questions reflect the topic emphasis of your state’s testing service and your Texas license exam.

    A word about the test questions… TX-RELEP’s testing practice section consists of ten national practice tests, six state practice tests, and one state exam sample test. The practice tests are roughly 50 questions in length and the sample test is 100 questions. The test questions are designed to cover the content covered by the law reviews – which reinforces your learning of the total body of information tested by your Texas exam. The questions are direct, to the point, and designed to test your understanding. When you have completed a given test, you can check your answers against the answer key in the appendix. You may also note that each question’s answer is accompanied by a brief explanation, or “rationale” to further reinforce your understanding.

    In the end, as you know, it’s all up to you. Unlike other publications, we are not going to tell you that using this book will guarantee that you pass your state exam. It still takes hard work and study to pass. But we have done our best here to get you ready. Following that, the most we can do is wish you the best of success in taking and passing your Texas real estate exam. So good luck!!

    All You Need to Know About the Music Business by veteran music lawyer Don Passman—dubbed “the industry bible” by the Los Angeles Times—is now updated to address the biggest transformation of the music industry yet: streaming.

    For more than twenty-five years, All You Need to Know About the Music Business has been universally regarded as the definitive guide to the music industry. Now in its tenth edition, Donald Passman leads novices and experts alike through what has been the most profound change in the music business since the days of wax cylinders and piano rolls. For the first time in history, music is no longer monetized by selling something—it’s monetized by how many times listeners stream a song. And that completely changes the ecosystem of the business, as Passman explains in detail.

    Since the advent of file-sharing technology in the late 1990s to the creation of the iPod, the music industry has been teetering on the brink of a major transformation—and with the newest switch to streaming music, this change has finally come to pass. Passman’s comprehensive guide offers timely, authoritative information from how to select and hire a winning team of advisors and structure their commissions and fees; navigate the ins and outs of record deals, songwriting, publishing, and copyrights; maximize concert, touring, and merchandising deals; and how the game is played in a streaming world.

    “If you want to be in music, you have to read this book,” says Adam Levine, lead singer and guitarist of Maroon 5. With its proven track record, this updated edition of All You Need to Know About the Music Business is more essential than ever for musicians, songwriters, lawyers, agents, promoters, publishers, executives, and managers—anyone trying to navigate the rapid transformation of the industry.
    Now in its third edition, California School Law is the only comprehensive source discussing how federal and state law affects the day-to-day operation of the state's traditional public, charter, and private schools. While the book is comprehensive, the authors have written it for a broad audience. California School Law has become a coveted desk-top reference for administrators, governing board members, school attorneys, union leaders, and policymakers. It also has been widely adopted as a classroom textbook in educational administration and education law classes.

    The first chapter provides an explanation of the legal framework within which California schooling takes place and key players at the state, district, and school level. Ensuing chapters examine student attendance and truancy, curriculum law, employment law, teacher and student rights of expression, the school and religion, students with disabilities, student discipline, privacy and search and seizure, and legal liability in both state and federal court.

    Also included are chapters on unions and collective bargaining, educational finance issues, and racial and gender discrimination. Appendices provide a glossary of legal terminology, an explanation of how to find and read legislative enactments and judicial decisions, and a list of sources for accessing law. The book's table of contents is included on this website.

    Law never stands still. To keep current with changing legal precedent, the authors maintain a cumulative update for the third edition at www.californiaschoollaw.org.
