Terms of Service

Stark Lab, Inc. ('us', 'we', or 'our') operates the Stark plugin for, but not limited to, Chrome.app, Sketch.app, Adobe XD.app, Figma.app, and the Stark website (the 'Service').
By purchasing and using our software, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing Stark. The materials contained in Stark are protected by applicable copyright law.
Use License
1. Permission is granted to download and install Stark within Chrome, Sketch, Adobe XD, or Figma.
Under this license you may not:
modify or copy the materials
attempt to decompile or reverse engineer any software contained in Stark; that’s not cool.
remove any copyright or other proprietary notations from the materials; or
transfer the materials to another person or "mirror" the materials on any other server.
transfer the materials to other persons the materials in the form of re-sale.
To put it simply: We work(ed) hard to design and build the Stark you see now so you could use it for free. The code and design are ours—we didn’t steal it—so we hope you don’t either. We do hope you use Stark, be it free or paid version, to create really accessible and in turn inclusive designs that ensure everyone can have a great experience.
2. Your use of Stark will be reviewed and/or removed if you violate any of these restrictions.
Purchasing Fee
Our pricing plans are simple and transparent that will allow you to use Stark within any software Stark is available. Currently in Chrome, Sketch, Adobe XD, and Figma. These plans (Free, Pro, and Team) can be found on our Pricing page.
Stark Lab, Inc., in its sole discretion and at any time, may modify the purchase fee.
A valid payment method is required to process the payment for your Purchase. We may add or remove the support for certain payment methods at our discretion. You shall provide Stark Lab, Inc. with accurate and complete billing information as required, including but not limited to full name, address, state, zip code, and valid payment method information.
We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected. We will not be held responsible or liable for any failure for the purchase to complete, or any resulting loss or damages to you.
Refunds
Stark is a subscription service with monthly and yearly terms. If you’d like to cancel and receive a refund, please reach out to us at [email protected] and we’ll take care of it for you.
We don’t do refunds on monthly plans. If you’re on a monthly plan, you must cancel before the monthly renewal date. If you’re on a yearly plan and you forget to cancel your subscription before the renewal date, please reach out to [email protected] within seven days after the renewal date to discuss a refund.
Privacy
We only ask for personal information like name and email when we truly need it to provide a service to you. We collect it in a fair and lawful manner, only with your knowledge and consent. We also let you know why we’re collecting it and how it will be used. For more information about your privacy can be found under our Privacy Policy.
Security
We use Mixpanel which uses the Google Cloud Platform to persistently store customer data and do not host customer data on our premises or store customer data with any other third party services. Google Cloud Platform holds industry best security certifications, such as SoC2 and ISO 27001, and provides encryption in transit and at rest. We also use a third-party payment system, Stripe for payment processing and no financial data (credit card number, expiration date, security code) is stored on our systems. Disclaimer
The Service is primarily intended for professional use. We sell the software business-to-business. In no event shall Stark Lab, LLC. be held liable or accountable for private customers using the Service, related to claims based on any consumer law.
The materials within Stark are provided on an 'as is' basis. Stark Lab, Inc. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Stark Lab, Inc. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to Stark.
Limitations
In no event shall Stark Lab, Inc. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Stark, even if Stark Lab, Inc. or a Stark Lab, Inc. authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Accuracy of Materials
The materials appearing in Stark could include technical errors. Stark Lab, Inc. does not warrant that any of the materials on Stark are accurate, complete or current. Stark Lab, Inc. may make changes to the materials contained in Stark at any time without notice. However Stark Lab, Inc. does not make any commitment to update the materials.
Modifications
Stark Lab, Inc. may legally revise these terms of service for its app at any time without notice. But we’ll always let you know when we update it. If you’re using it, you should know the terms of that use. But by using Stark you are agreeing to be bound by the then current version of these terms of service.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the United States of America and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
