Customer Terms

The GitHub Customer Agreement applies to all GitHub Products, Professional Services and Support for enterprise customers.

General Terms

• General Terms

Our base agreement for any enterprise purchase. If you are a Microsoft enterprise customer, your Microsoft agreement governs instead.

The following addenda also apply, depending on what product(s) you purchase:

Product Specific Terms

• GitHub Enterprise Cloud

  If you license GitHub Enterprise Cloud then this Cloud addendum applies. If you license GitHub Enterprise then both the Cloud and Server addenda apply.

• GitHub Enterprise Cloud (Enterprise Managed Users)

  If you license GitHub Enterprise Cloud (EMU) then this Cloud (EMU) addendum applies. If you license GitHub Enterprise then both the Cloud (EMU) and Server addenda apply.

• GitHub Enterprise Server

  If you license GitHub Enterprise Server then this Server addendum applies. If you license GitHub Enterprise then both the Cloud and Server addenda apply.

• GitHub AE

  If you license GitHub AE then this GitHub AE addendum applies.

Additional Terms

• GitHub Data Protection Agreement

  The DPA applies to Cloud, Cloud-EMU and GitHub AE and is referenced in those addenda.

• GitHub Addendum to Microsoft Data Protection Agreement

  This Microsoft DPA addendum applies to Microsoft customers who are purchasing Cloud, Cloud-EMU and GitHub AE.

• GitHub Online Services SLA

  The SLA applies to Cloud, Cloud-EMU and GitHub AE and is referenced in those addenda.

• U.S. Public Sector Amendment

  This addendum applies in addition to the others if you are a U.S. government entity.

• Educational Institution Amendment

  If you license as part of our educational programs, then this amendment applies in addition to the General Terms, the Product Specific Terms and Additional Terms.
