The SCOTUS decision in United States v. Arthrex is an important and timely reminder that the Director of the Patent Office needs to be accountable through the political process for the enormous power that comes with the position.

We asked the Court to “limit[] the ability of public schools to reach into and regulate the private lives of students.” Justice Breyer noted this fact: "regulations of off-campus speech, when coupled with regulations of on-campus speech, include all the speech a student utters".

A snippet from the opinion. It reads, "rfom the student speaker’s perspective, regulations of off-campus speech, when coupled with regulations of on-campus speech, include all the speech a student utters during the full 24-hour day. That means courts must be more skeptical of a school’s efforts to regulate off-campus speech, for doing so may mean the student cannot engage in that kind of speech at all.”

In our brief, we wrote that “social media is a central means for young people to express themselves, connect with others, and engage in advocacy surrounding issues they care about.” Justice Breyer acknowledged this in the Court's opinion:

A snippet from the opinion. It reads: "the school itself has an interest in protecting a student's unpopular expression, especially when the expression takes place off campus. America's public schools are the nurseries of democracy."

The Court also rightfully declined to give lesser protection to students’ speech on social media. This is critical, given that public school students, like most young people, use social media to engage in a wide variety of self-expression, political speech, and activism.

This is an important victory for the free speech rights of public school students. We’re pleased that the Supreme Court recognized that public school officials are sharply limited in punishing students’ off-campus speech, even when it is vulgar.
