ACX Conditions of Use

This is an agreement between you and Audible, Inc. (with its affiliates, "Audible", "we" or "us") regarding the Audible Creation Exchange ("ACX") and ACX.com (the "Site"). The rules, policies and guidance we provide regarding ACX and the Site, the Amazon.com Conditions of Use and the Amazon.com Privacy Notice (all as they may be changed over time) are collectively referred to as the "Terms" and govern your use of the Site. ACX and the Site are Amazon Services for the purposes of the Amazon.com Conditions of Use. These ACX Conditions of Use will take precedence over any conflicting provisions of the Amazon.com Conditions of Use to the extent of any conflict. In addition, when you use any current or future Amazon, Audible, ACX or Site services or businesses you also will be subject to the guidelines, terms and agreements, including, without limitation, any Account Holder Agreement, Book Posting Agreement, Catalog Subscription Service Agreement, Production Standard Terms and Offer and Acceptable Policy, applicable to such services or businesses ("Additional Terms"). If these Terms are inconsistent with any Additional Terms, the Additional Terms will control to the extent of any inconsistency.

By using the Site or signing up for an account, you agree to the Terms.

Agreement Changes

We may, in our discretion, change the Terms and all elements of them and any aspect of ACX and the Site without notice to you. If any such change is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or the Terms. Your continued use of ACX and the Site after we change the Terms constitutes your acceptance of the changes. If you do not agree to any changes, you must not use ACX and the Site.

DISPUTES; LIMITATION OF LIABILITY

Any dispute or claim arising from or relating to these Terms or your use of ACX and the Site is subject to the dispute resolution, governing law, disclaimer of warranties, limitation of liability and all other terms in the Amazon.com Conditions of Use.
